Non-Residents on the Open Areas

We've been told that a member of the public walking on the open space was accosted by someone, presumably a resident, and told that they had no right to walk on the area as it is private.


Details below, but the upshot is that residents have no authority to tell anyone to leave and we advise that people don't try to do so. Its annoying when people who don't pay for the maintenance of the land leave litter and dog mess on it, but there is nothing we can do about it.


The exact status of the open areas is complicated: the land is privately owned by Holdings & Management (Solitaire) Ltd. There is some documentation suggesting an intention to dedicate some of this area to public use, but nothing confirming that this was done. This is a matter of dispute between us and Fareham Borough Council. There are signs up saying that the land is private.


However, regardless of the status of the land, it is only the landowner themselves or their authorised representatives who can order someone to leave it. We residents are not authorised representatives of Holdings & Management (Solitaire) Ltd, so we don't have the authority to do this.
